Please read these terms carefully before submitting your tenancy application.
The name which is mentioned in the onboarding form should be according to your valid passport. If the name does not match the passport, Brandenbed Living Spaces UG reserves the right to redraft the tenancy agreement, and the tenant will be required to pay an administrative fee of 30 EUR (thirty euros).
Tenants must provide valid and current identification documents including a passport, resident permit, or valid visa. Expired documents will not be accepted.
Once the onboarding form has been fully completed and submitted, and you have formally booked a bedspace, you are considered an official tenant of Brandenbed Living Spaces UG. All rights and obligations under these terms commence from the contract start date.
The minimum tenancy period is one (1) year from the contract start date. The contract end date will be automatically calculated accordingly and cannot be altered without mutual written agreement.
As soon as you are our tenant, you are obligated to follow the house rules which are mentioned on the back of the main door of the apartment. In case the house rules are not available on the door, please contact our management team to receive a copy and follow those rules diligently.
Any damages in the apartment must be reported to us within the first month of your tenancy. You should document and report all pre-existing damage or defects that you notice upon moving in.
After the completion of the first month, Brandenbed Living Spaces UG will not be liable for any damage or repairs that were not reported during the initial period. Unreported damages discovered at the end of the tenancy will be charged to the outgoing tenant.
You are required to adhere strictly to the notice period as communicated to you in your tenancy agreement. Failure to provide adequate notice may result in the forfeiture of all or part of your security deposit.
The deposit will be withheld in the following circumstances:
Where the deposit is sufficient to cover outstanding amounts, the remainder will be returned to the tenant within 30 days of departure.
Wi-Fi is provided as an amenity to all tenants. In the event of any technical problems or connectivity issues, Brandenbed Living Spaces UG is not liable or responsible for any disruption to the internet connection. We will make reasonable efforts to restore service, but do not guarantee continuous or uninterrupted Wi-Fi access.
Other shared amenities are provided on a best-effort basis. Brandenbed Living Spaces UG shall not be liable for temporary unavailability of shared amenities due to maintenance, technical faults, or circumstances beyond our control.
Tenants are required to send photos either via the Brandenbed WhatsApp Tenant Desk or by email to allow us to inspect the status and cleanliness of the apartment. This inspection may be carried out by anyone present in the apartment; however, at least one occupant must send photos or a video of the entire property.
Inspections may be scheduled periodically and tenants will be given reasonable advance notice. Failure to cooperate with inspection requests may be treated as a breach of tenancy obligations.
Rent must be paid on or before the due date as specified in your tenancy agreement. You agree to pay a fine of 5 EUR (five euros) per day for each day that the rent remains unpaid beyond the due date.
Requests for direct payment must be acknowledged and processed only through official email communication. Bank transfer or direct payment requests made through unofficial channels should be verified before any payment is made.
In case of cosmetic repairs or damage discovered after the tenancy is completed, the following applies:
The apartment is provided exclusively for residential use. It must not be used for commercial purposes, short-term subletting, or any activity that is illegal under German law or Berlin municipal regulations.
Subletting of the rented bedspace or any part of the apartment is strictly prohibited without prior written consent from Brandenbed Living Spaces UG. Unauthorised subletting constitutes a material breach of the tenancy agreement and may result in immediate termination of the tenancy.
Tenants may have occasional guests but must ensure that guests do not disturb other occupants. Overnight guests are permitted for a maximum of 3 consecutive nights. Extended stays by guests must be pre-approved in writing by management. Guests who reside in the apartment for more than 7 days in any calendar month may be required to be added to the tenancy agreement.
Brandenbed Living Spaces UG collects and processes personal data including identification documents, contact details, and payment information in accordance with the General Data Protection Regulation (GDPR) as applicable in Germany. Your data will be used solely for tenancy management purposes and will not be shared with third parties without your explicit consent, unless required by law.
You have the right to access, correct, or request deletion of your personal data at any time by contacting our management team.
These Terms and Conditions and all tenancy agreements issued by Brandenbed Living Spaces UG are governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.
Brandenbed Living Spaces UG reserves the right to amend or update these Terms and Conditions at any time. Tenants will be notified of any significant changes via email or written notice at least 30 days in advance. Continued occupation of the property after the effective date of any change constitutes acceptance of the updated terms.
The property management company lets the sub-tenant the agreed apartment exclusively for residential purposes. The apartment is handed over furnished. The personal furniture included in the rent (mattress, bed, cupboard, etc.) and the shared facilities available to the tenant (Wi-Fi, kitchen, bathroom, balcony, etc.) are specified in the individual lease agreement.
Handover of the apartment takes place only after receipt of the full first month's rent and the first deposit instalment.
Persons other than spouses or civil partners, children, parents, or their domestic employees may only permanently occupy the apartment with the prior consent of Brandenbed Living Spaces UG.
Brandenbed Living Spaces UG undertakes to provide the tenant with the confirmation required for registration and de-registration (Wohnungsgeberbestätigung) pursuant to § 19 of the Federal Registration Act (Bundesmeldegesetz) in due time.
For the duration of the tenancy the tenant will be provided with one front-door key and one apartment key. If the tenant loses one or more keys, the loss must be reported immediately to management. All costs arising from replacement or lock changes shall be borne by the tenant.
The tenancy commences and ends on the dates specified in the individual lease agreement; no separate notice of termination is required for a fixed-term lease.
The purpose of the tenancy (e.g. student accommodation) is specified in the individual contract and may not be changed without written agreement.
The monthly rent is as stated in the individual lease agreement. All operating costs (Betriebskosten), including utilities, water, and building maintenance, are included in the stated monthly rent. No separate utility bills will be issued.
Cleaning equipment is not included in the rent and remains the responsibility of the tenant.
Rent must be transferred by bank transfer, payable monthly in advance, no later than the third working day of each month. The following account details apply for rent payments:
Cash payments are not accepted. All transfers must include the tenant's full name and apartment as the payment reference.
The tenant is required to pay a security deposit in the amount stated in the individual lease agreement. Deposit payments must be made to the following account:
Tenants are required to ensure adequate ventilation of the apartment. As a rule, windows should be opened three to four times per day for at least ten minutes each time to prevent mould and condensation.
Grilling of any kind (on balconies, terraces, or any part of the property) is strictly prohibited.
The tenant is obligated to pay for repairs to items that are subject to their frequent and direct use (such as taps, door handles, window fittings, electrical sockets, and similar fixtures), provided that the individual repair cost does not exceed €100.00 (net) per item.
The total annual liability of the tenant for such minor repairs is capped at 8% of the annual gross rent as stated in the individual lease agreement.
Keeping pets of any kind in the apartment is strictly prohibited. Violation of this prohibition will result in an immediate fine of €100 (one hundred euros) per incident, and may constitute grounds for termination of the tenancy agreement.
Upon the end of the tenancy, the tenant must:
Failure to return the property in the required condition will result in deductions from the security deposit to cover cleaning and restoration costs.
These terms and all lease agreements are governed exclusively by the laws of the Federal Republic of Germany. Any amendments to the tenancy agreement must be made in writing and signed by both parties.
Should any individual provision of these terms or the lease agreement be or become invalid, the remaining provisions shall continue in full force. The invalid provision shall be replaced by the legally valid provision that most closely reflects the economic intention of the original clause (Salvatorische Klausel).
By submitting the onboarding form and ticking the acceptance checkbox, the tenant confirms they have read, understood, and agreed to all provisions above, including all clauses of the standard Mietvertrag issued by Brandenbed Living Spaces UG.
